1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the products and services (“Services”) operated by Domato (“we”, “our”, “us”), including but not limited to:
- domato.ai — our corporate website
- realestate.domato.ai — BrokerIQ
- publiciq.domato.ai — PublicIQ
By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services. If you are using our Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of services
Domato provides AI-powered products designed to help individuals and organisations make better decisions. Our Services include:
- BrokerIQ: An all-in-one workspace for Australian mortgage brokers, including scenario management, client intake, quick calculators, CDR market rates, Gmail integration, and team collaboration tools.
- PublicIQ: A searchable data exploration platform aggregating census demographics, crime statistics, and government data across 2,400+ Australian statistical areas.
Each product operates on a separate domain and may have distinct features, account requirements, and usage conditions. Where a product introduces additional terms, those terms will be presented to you and will supplement (not replace) these Terms unless expressly stated.
3. Accounts and access
Some of our Services may require you to create an account or authenticate to access certain features. When you create an account, you agree to:
- Provide accurate and complete information
- Keep your login credentials secure and confidential
- Notify us promptly if you suspect unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or disable accounts that violate these Terms or that we reasonably believe have been compromised.
4. Acceptable use
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates applicable laws or regulations
- Attempt to gain unauthorised access to any part of our Services, infrastructure, or other users' accounts
- Use automated tools (bots, scrapers, crawlers) to access or extract data from our Services without our prior written consent
- Interfere with or disrupt the integrity or performance of the Services
- Reverse-engineer, decompile, or attempt to extract the source code of our Services
- Resell, redistribute, or sublicence access to our Services without authorisation
- Use AI-generated outputs from our Services to build competing products or datasets without our consent
5. AI-generated content and outputs
Our Services use artificial intelligence to generate insights, summaries, comparisons, and recommendations. You acknowledge and agree that:
- Outputs are informational only. AI-generated content is provided for general information purposes and should not be treated as professional advice (financial, legal, medical, or otherwise).
- No guarantee of accuracy. While we strive to provide accurate and up-to-date information, AI outputs may contain errors, omissions, or outdated data. You are responsible for independently verifying any information before relying on it for decisions.
- BrokerIQ. Loan scenarios, calculations, and CDR market rate data are provided as tools to support broker workflows. They do not constitute financial advice, credit recommendations, or guarantees about lending products or outcomes.
- PublicIQ. Census demographics, crime statistics, and government data are sourced from official public datasets and should be validated against primary sources before use in research or policy decisions.
6. User content
You retain ownership of any content you submit, upload, or input through our Services (“User Content”), including search queries, loan scenarios, contact form submissions, and documents provided for deployments.
By submitting User Content, you grant Domato a limited, non-exclusive licence to use, process, and store that content solely as necessary to provide and improve the specific Service you are using. We will not use your User Content for unrelated purposes or share it with other customers without your consent.
For enterprise deployments, the handling of organisational documents and data is governed by the applicable client agreement, which may include additional protections and restrictions.
7. Intellectual property
All content, features, functionality, branding, and technology comprising our Services are owned by Domato or our licensors and are protected by Australian and international intellectual property laws. This includes but is not limited to software, algorithms, designs, text, graphics, logos, and trademarks.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of our Services without our prior written consent, except as expressly permitted by these Terms or by law.
8. Third-party services and data
Our Services may integrate with or contain links to third-party websites, APIs, or services. We are not responsible for the content, accuracy, availability, or practices of third parties. Your use of third-party services is subject to their respective terms and policies.
Some of our products rely on publicly available data sourced from government databases, public records, and other open datasets. We endeavour to use reliable sources but do not guarantee the completeness, accuracy, or timeliness of third-party data.
9. Fees and payment
Some of our Services may be offered free of charge, while others may require payment or a subscription. Where fees apply, pricing and payment terms will be presented to you before purchase. Unless otherwise stated, all fees are quoted in Australian dollars and are inclusive of GST where applicable.
For enterprise deployments, fees and payment terms are defined in the applicable client agreement.
10. Service availability
We aim to keep our Services available and reliable, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of our Services at any time, with or without notice. Scheduled maintenance or updates may temporarily affect availability.
11. Disclaimers
To the maximum extent permitted by law, our Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, Domato does not warrant that:
- The Services will meet your specific requirements
- AI-generated outputs will be accurate, complete, or current
- The Services will be uninterrupted, timely, or free from errors
- Any data derived from public sources will be error-free or comprehensive
You acknowledge that Domato's products are tools to assist decision-making, not replacements for professional judgement. You are solely responsible for decisions made using our Services.
12. Limitation of liability
To the fullest extent permitted by Australian law (including the Australian Consumer Law), Domato shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) our Services, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or goodwill
- Decisions made based on AI-generated outputs or public data analysis
- Lending decisions informed by broker workspace calculations or market rate data
- Actions taken based on public data analysis from PublicIQ
Where our liability cannot be excluded by law, our total aggregate liability to you for all claims arising from or related to our Services shall not exceed the amount you paid to Domato in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or other consumer protection legislation that cannot be excluded or limited by contract.
13. Indemnification
You agree to indemnify and hold harmless Domato, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to our Services at any time if we reasonably believe you have violated these Terms, or for any other reason at our discretion with reasonable notice. You may stop using our Services at any time.
Upon termination, your right to access the Services will cease immediately. Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
15. Changes to these terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from or related to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
Before pursuing formal legal action, you agree to first attempt to resolve any dispute informally by contacting us. We will make reasonable efforts to resolve the matter within a reasonable timeframe.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire agreement
These Terms, together with our Privacy Policy and any product-specific terms or client agreements, constitute the entire agreement between you and Domato regarding your use of our Services. These Terms supersede any prior agreements or understandings, whether written or oral.
